Justice injunction involving overthrow of the Port of Paranaguá

In the late afternoon of July 1st, federal judge Sérgio Renato Tejada Garcia determined the prohibition of demonstrations against the demolition work, which block the access channel to the Port of Paranaguá. Interlocutory appeal No. 5027057-21.2021.4.04.0000/PR was filed by the port administration to avoid economic losses caused throughout the logistics chain by the stoppage of the entry of ships in the port.

The decision considers that “the enormous damages resulting from the inhibition of the entry of ships at the wharf are undeniable and affect not only the port authority but also all others involved in the port logistics chain (maritime agents, terminals, port operators, truck drivers – which formed long lines when the protest was held on 06/24/2021, awaiting release to enter the port strip – charterers, importers and exporters), not to mention society as a whole, as the strategic importance of the port in question is undeniable for Brazil”.

The magistrate continues “In view of these considerations, I grant, in part, the intended urgent relief and determine the immediate clearance of the waterway access channel to the Port of Paranaguá, and the protesters must refrain from holding any protest in this area (nothing hindering that any other protests, provided that they are lawful and peaceful, are carried out outside this location), under penalty of a fine of BRL 10,000.00 (ten thousand reais) per day, to be applied to the requested association, given the seriousness of the situation and the economic losses arising therefrom”.

On average, the Port of Paranaguá moves US$ 120,989,442.00 of cargo per day. In the first five months of the year, the state’s ports handled a total of 24,343,390 tons.
