Specialists warn of problems and shutdown risk at Santos

A problem that did not exist a year ago is trying the patience of the maritime agents in the Port of Santos: a one- or two-day suspension of activities as a penalty for delays in delivering cargo documentation.

Faced with an impasse and looking for a solution for a problem that has already affected six agents from February until now (Libra, Geodis Freight Management, Zim do Brasil, Maersk, MSC Mediterranean, and Rochamar), a public hearing took place this week entitled “The Siscarga penalties:  fines, warning penalties, suspension, and forfeiture.”  The public hearing took place in Santos to discuss Siscomex Carga, also known as Siscarga, which controls all cargo movements, empty containers, and vessels that transit in Brazilian waterways.

The law stipulates that shipping agents receive a warning when documentation delivery is delayed more than three times in one month. In the case of recurrence, the agents can lose their right to exercise their customs activities for up to 365 days.

The public hearing dealt with one of the most sensitive issues for the Port of Santos community. This year, the port began to apply one- or two-day activity-suspension penalties to maritime agents and cargo agents. This was in addition to the well-known R$5,000 fine for late delivery of information to Siscomex Carga. The suspension of maritime agent activities could paralyze the Port of Santos by harming all Brazilian foreign trade and preventing goods from being exported and imported. This would only aggravate the country’s trade situation during the pandemic. For Ene, the customs authorities misrepresented the rules that impose the suspension penalty to those involved in the federal revenue system.
