After 4 years of legal disputes, construction work resumes at the Port of Jaconé, in Maricá

The Ponta Negra Port Terminals in Maricá were permitted to resume construction works after four years of legal dispute. On July 22, the president of the federal regional court of the 2nd region, Judge Messod Azulay Neto, suspended an injunction preventing the works.

The decision meets an appeal by the state attorney general (PGE-RJ) against the lower court decision, which had annulled the previous environmental licensing for the Port of Jaconé. According to estimates by the state government, the project should attract R$ 2.5 billion in investments.

The federal attorney general and the attorney general of Rio de Janeiro filed a public civil action against the State of Rio de Janeiro, INEA (the state environmental institute), DTA Engenharia, the federal government, IBAMA, and Marica City Hall. In addition to the annulment of the previous environmental license granted to the Port of Jaconé, they asked for the prohibition of any authorization to start construction and a conviction for collective moral damages.

The reason given for the lawsuit is that the work threatens the existing rock formations – the so-called ‘beach rocks’ – which were mentioned during the route of the British naturalist Charles Darwin’s expedition to Brazil in the 19th century.

The entity responsible for the project, DTA Engenharia, claims that it has already altered the original project to resolve this and other issues.

According to the state, this will be the largest liquid bulk terminal in the southern hemisphere and will allow the absorption of cargo that cannot be sent via the terminals in Guanabara Bay and Angra dos Reis. In addition, it will house the largest container terminal in Latin America, capable of receiving large-capacity ships.
